Welcome to Delight of my Art. These Terms of Service (“Terms”) govern your use of the Delight of my Art website, memberships, subscriptions, tutorials, classes, videos, downloadable materials, physical products and kits, and other products and services offered directly by Delight of my Art (collectively, the “Services”).

By accessing our website, creating an account, purchasing a product, enrolling in a membership, or otherwise using our Services, you agree to these Terms.

If you do not agree to these Terms, please do not use the Services.

1. About Delight of my Art

Delight of my Art provides card-making education, inspiration, tutorials, videos, classes, memberships, digital resources, crafting kits, and related products and services.

Delight of my Art is based in Michigan, United States.

Throughout these Terms, “Delight of my Art,” “we,” “us,” and “our” refer to the business operating the Delight of my Art website and Services.

2. Accounts and Eligibility

You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to make purchases or enter into paid subscriptions through our website.

Some Services may require you to create an account.

You are responsible for:

Providing accurate account and contact information;

Keeping your username and password secure; and

Activity occurring through your account.

Paid memberships, tutorials, videos, downloads, and account credentials are intended for use by the individual who purchased them and may not be shared with others unless we specifically state otherwise.

3. Purchases and Payments

Prices and payment terms will be displayed at the time of purchase.

By submitting payment information, you authorize Delight of my Art and its payment processors to charge the applicable amount to your selected payment method.

Applicable taxes and shipping charges may be added when required.

Prices, promotions, product availability, and membership offerings may change. Changes will not retroactively alter the price of a completed one-time purchase.

Recurring memberships are subject to the subscription terms described below.

4. The Delightful Card Vault and Other Memberships

The Delightful Card Vault and certain other Delight of my Art programs may be offered as recurring subscriptions.

A Vault membership provides access to the content included in the Vault for as long as your applicable membership remains active.

When you purchase a recurring subscription, you authorize us to automatically charge your selected payment method at the billing interval and price presented at checkout until the subscription is canceled.

Unless otherwise stated when you enroll:

Monthly memberships renew automatically each month.

Annual memberships renew automatically each year.

You may cancel your subscription at any time to prevent the next renewal.

Cancellation does not normally result in a refund for a billing period that has already begun.

After cancellation, you will generally continue to have access through the end of the period for which you have already paid.

When your paid membership period ends, access to membership-only content may end.

Canceling a membership stops future recurring charges. It does not convert membership content into permanently owned content.

5. Founding Member Memberships

Delight of my Art may offer special Founding Member pricing for the Delightful Card Vault or other membership programs.

When an offer states that Founding Member pricing is “locked in,” the qualifying member may continue receiving that price while the membership remains continuously active, subject to the terms presented with the offer.

If a Founding Member cancels the membership, fails to make a required payment, or otherwise allows the membership to lapse, the Founding Member price may be forfeited.

If the person later rejoins, the then-current membership price may apply.

Founding Member offers may be limited to a specific number of members or enrollment period. Once that limit is reached or the offer ends, we are not required to make the promotional price available to additional members.

6. Individually Purchased Tutorials and Classes

Some tutorials, classes, videos, PDFs, and other digital products may be sold individually rather than provided through a recurring membership.

The access terms stated when you purchase an individual product control your access to that product.

If an individual tutorial or class was sold with a promise of lifetime access, we will honor that access according to the terms under which it was originally purchased.

Membership cancellation does not eliminate separate access rights you received through an individual purchase.

Likewise, access to content through a Vault or other subscription does not automatically create lifetime ownership or permanent access to that content.

7. Digital Products and Refunds

Many Delight of my Art products provide immediate access to digital materials, including PDFs, tutorials, videos, class materials, templates, instructions, and membership content.

Because digital products cannot effectively be returned after they have been accessed or delivered, purchases of digital products and previously billed subscription periods are generally non-refundable unless:

A different refund policy was specifically stated at the time of purchase;

We determine that a refund is appropriate because of an error on our part; or

A refund is required by applicable law.

If you have difficulty accessing something you purchased, please contact us. We want you to receive the content you paid for and will make reasonable efforts to resolve legitimate technical or account-access problems.

8. Physical Products and Crafting Kits

From time to time, Delight of my Art may sell or provide physical products, pre-cut card kits, class materials, promotional items, or other physical goods.

Availability may be limited.

Any shipping or delivery estimates are estimates rather than guaranteed delivery dates unless expressly stated otherwise.

Customers are responsible for providing an accurate shipping address. If an order is returned or cannot be delivered because incorrect shipping information was provided, additional shipping charges may apply.

If a package arrives damaged, contains incorrect items, or appears to have been lost in transit, please contact us within a reasonable time so we can investigate and determine an appropriate solution.

Certain kits may contain consumable, customized, limited-availability, or pre-cut materials and therefore may not be eligible for return once shipped except where required by law or where the product is defective or incorrect.

9. Copyright and Intellectual Property

The original tutorials, written instructions, photographs, videos, graphics, downloadable files, class materials, website content, branding, and other original materials created by Delight of my Art are protected by applicable copyright and intellectual property laws.

Purchasing a tutorial, class, membership, or other product gives you permission to use the applicable material according to these Terms.

Your purchase does not transfer ownership or copyright in our materials to you.

Unless expressly permitted by us, you may not:

Copy or redistribute our PDFs, tutorials, instructions, videos, photographs, or downloadable files;

Share paid downloads with friends, customers, team members, or other demonstrators;

Share membership usernames, passwords, private links, or other methods of accessing paid content;

Upload our paid materials to websites, Facebook groups, social media, cloud drives, file-sharing services, or other platforms for distribution;

Sell or redistribute our tutorial files or instructional materials;

Record and redistribute paid video classes;

Remove copyright or ownership notices from our materials; or

Represent our original content as your own.

You may download or print materials for your own permitted use where downloading or printing is provided as part of the product.

10. Handmade Projects and Demonstrator Use

We love seeing people actually make the projects we teach.

Unless a particular tutorial states otherwise, you may use our tutorials to create handmade cards and projects for:

Personal use;

Gifts;

Classes you personally teach; and

Small-scale sales of finished handmade projects.

Stampin’ Up! demonstrators and other crafting instructors may use our projects as inspiration or as a guide when preparing their own classes and instructional materials.

However, purchasing one of our tutorials does not give you permission to distribute our original PDF, written instructions, photographs, videos, or other copyrighted instructional materials to your customers, team members, or class participants.

If you reproduce one of our original card designs substantially as shown for a class, demonstration, or other public presentation, we appreciate appropriate credit to Delight of my Art and Deb Joy Smeak as the source of the original design.

You may create your own instructions and class materials based on techniques or projects you have learned, provided you do not simply copy or redistribute our copyrighted instructional materials.

11. Stampin’ Up!

Delight of my Art features and uses products manufactured or distributed by Stampin’ Up! and may provide links through which customers can purchase Stampin’ Up! products.

Stampin’ Up!, its logos, product names, trademarks, copyrighted materials, and other intellectual property belong to their respective owners.

Delight of my Art is operated independently and is not the corporate website of Stampin’ Up!

When you follow a link from Delight of my Art and purchase products directly through Stampin’ Up!, that transaction is processed by Stampin’ Up. Applicable Stampin’ Up! ordering, shipping, return, privacy, and other policies may govern that transaction.

Delight of my Art cannot guarantee the continued availability of Stampin’ Up! products shown in older tutorials.

Products may retire, sell out, change, or become unavailable over time.

12. Older and Archived Tutorials

One of the benefits of the Delightful Card Vault and our tutorial library is access to projects created over many years.

As a result, some products, stamp sets, dies, designer papers, embellishments, colors, or other supplies shown in older tutorials may no longer be available.

We may suggest substitutions when appropriate, but access to a tutorial does not guarantee that its original materials remain commercially available.

13. Changes to Membership Content

We expect our membership programs to grow and evolve.

We may add, reorganize, update, replace, or occasionally remove content from an active subscription library. We may also change the technology, website structure, hosting platform, or organization used to provide membership content.

This provision applies to subscription-library content and does not override lifetime or other permanent access rights expressly provided with an individual purchase.

14. Acceptable Use

You agree not to misuse the Delight of my Art website, membership, or Services.

You may not:

Attempt to access another member’s account;

Share an account to avoid purchasing additional access;

Circumvent membership or payment restrictions;

Systematically scrape, copy, or download our content for redistribution;

Interfere with the security or operation of our website;

Use our Services for fraudulent or unlawful purposes; or

Use our content in a manner that infringes our intellectual property rights.

We may suspend or terminate access if we reasonably believe an account is being used fraudulently, shared improperly, used to distribute protected materials, or otherwise used in violation of these Terms.

15. Third-Party Websites and Services

Our website may contain links to or integrations with third-party services, including payment processors, email providers, video platforms, social media services, crafting suppliers, Stampin’ Up!, and other websites.

Third-party services operate under their own terms and privacy policies.

We are not responsible for the availability, security, content, policies, products, or services of independent third-party providers.

16. Email and Other Communications

When you purchase a product, create an account, join a membership, or otherwise interact with us, we may send communications necessary to administer your account, purchase, subscription, class, or requested service.

If you choose to receive promotional or marketing communications, you may unsubscribe using the unsubscribe option included in those messages.

Unsubscribing from marketing emails does not necessarily stop transactional messages necessary to provide an active membership or fulfill a purchase.

Our collection and use of personal information is further described in our Privacy Policy.

17. Educational and Creative Content Disclaimer

Our tutorials and classes are provided for educational, informational, and creative purposes.

We make reasonable efforts to provide accurate instructions and useful information, but crafting results can vary depending on materials, equipment, techniques, individual skill, and product availability.

The Services are provided on an “as is” and “as available” basis to the extent permitted by applicable law.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Delight of my Art will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our Services.

To the extent permitted by law, our total liability relating to a purchased product or service will not exceed the amount you paid directly to Delight of my Art for the product or service giving rise to the claim.

Nothing in these Terms limits any consumer right or remedy that cannot legally be limited or waived.

19. Changes to These Terms

We may update these Terms when our Services, technology, business practices, or legal requirements change.

When we make changes, the revised Terms will be posted on our website with an updated “Last Updated” date.

Changes will apply prospectively to the extent required by applicable law and will not eliminate access or other rights expressly promised as part of a previous individual purchase.

20. Termination

You may stop using our Services at any time.

We may suspend or terminate an account when reasonably necessary because of fraud, nonpayment, unauthorized sharing or distribution of our content, misuse of our Services, violation of these Terms, or unlawful activity.

Termination does not eliminate rights or obligations that arose before termination.

21. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles, except where applicable law requires otherwise.

22. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

23. Entire Agreement

These Terms, together with our Privacy Policy, any applicable Refund and Cancellation Policy, and any additional terms clearly presented with a specific product, membership, promotion, or purchase, constitute the applicable agreement regarding your use of the Services.

If specific terms presented at checkout conflict with these general Terms regarding a particular purchase, the specific terms presented for that purchase will control.
